Get early legal advice for the best outcome on building and construction disputes

Building and construction disputes are complex and require early advice from a legal professional to ensure the best possible outcome.

Legislation and regulations

In Queensland building and construction disputes can be governed by up to 12 different pieces of legislation. Amongst others and the myriad of Regulations, these include the:

  1. Building Industry Fairness (Security of Payment) Act 2017;
  2. Building Act 1975;
  3. Plumbing and Drainage Act 2002; and
  4. Queensland Building and Construction Commission Act 1991

Queensland Building and Constructions Commission

Queensland’s building and construction industry regulator, known as the Queensland Building and Construction Commission (‘QBCC’), can often be difficult to deal with and is known for vigorously pursuing wrong doers under their powers. If you receive correspondence from the QBCC you should immediately seek professional legal advice before responding.

Don’t delay

Our advice is to always obtain professional legal advice in a building and construction dispute early. Time is often of the essence in these disputes.

Ignoring notices or delaying taking advice could result in further losses, you being barred from responding to the other side’s allegations or even worse, automatically having a decision made against you. Further, as parties to a dispute have an obligation to mitigate their loss, leaving a construction site shut down with on hired building equipment or suffering further losses could impact your position as the dispute wears on.
